Why is it important for an Agent to think like an Inventor?

An agent who is also an inventor can help you in your quest to obtain patent protection on your ideas, just as an agent who is not an inventor.

But what traits of an inventor are useful for an agent to possess?

Here are a few of the more useful ...

  • An inventor sees things - An inventor will notice things others do not.
  • An inventor asks questions - Not only will an inventor notice things, but they take the extra step of asking "why?" or "why not?"
  • Inventors don't give up - Take Thomas Edison, he tried hundreds of different types of filaments before he found one that worked. As an agent this tenacity is useful in discovering all ramifications of an idea, thus providing maximum protection for a client.
  • Inventors apply inventive skills to numbers of different disciplines - An inventor who is also an agent can help clients in a range of technologies, because as an inventor, many things catch their eye. Such an agent is interested in knowing how things work and applying this interest to the benefit of a client.
  • Inventors understand secrecy- All registered patent agents and attorneys are bound by the ethical codicils of Title 37, Code of Federal Regulations, Chapter 10 (37 CFR 10, see PTO details). This chapter, entitled "Representation of Others Before the Patent and Trademark Office", lists all the rules an attorney or agent must follow, such as the "Canons and Disciplinary Rules" that are part of the "Patent and Trademark Office Code of Professional Responsibility" (37 CFR 10.20 ff., see PTO details). But an agent / inventor understands if an inventor worries about revealing an idea to another party. An agent / inventor will take steps to explain the Cannons and Rules of the PTO and go further to help the inventor be secretive enough to protect the idea, while revealing it only in the proper manner, and at the proper time. An example of this philosophy is on our home page, where inventors are urged to "not describe your idea in this e-mail to us or anyone in any other non-confidential manner".

    Many times, a would-be inventor might not seek an agent to help in the crafting of a patent application, feeling it too difficult to trust a stranger. We understand this sentiment, having had it ourselves, and will strive to gain the trust of our clients by providing the best representation available!
